Out-of-State Drivers
Alameda County DUI Lawyer
It is always a complicated issue when an out-of-state driver is arrested for DUI in California. If you are a non-California resident, it will be a great benefit to hire a DUI lawyer who has experience representing out-of-state drivers who have been charged with DUI while in California. All non-California residents arrested on DUI charges in California are still required to schedule a hearing with the California DMV.
As soon as a person is arrested for drunk driving, his/her driver's license will be immediately suspended and the legal process will begin, regardless of whether or not he/she is a California resident. Therefore, it's important for any non-California resident to schedule a hearing with the California DMV within 10 days following his/her arrest. Failure to do so will result in the automatic suspension of his/her driving privileges in the state of California.
Interstate Driver's License Compact
It's important for all out-of-state drivers to take their California DUI arrest seriously. Because California is a member of the Interstate Driver's License Compact (IDLC), out-of-state DUI offenders will not only face legal consequences in California, but they will also face legal consequences in their home state as well.
As soon as an out-of-state driver is arrested for DUI, California law enforcement authorities will inform the authorities in the driver's home state of his/her DUI arrest. Once the driver returns home, he/she will face criminal prosecution in their own state. The IDLC is an agreement between 45 states to share information when a driver is arrested, charged, or cited for a traffic violation.
There are only 5 states in the country that are not members of the IDLC: Georgia, Massachusetts, Michigan, Tennessee, and Wisconsin. If a driver is a resident of one of these states, he/she will still face legal prosecution in California, but the authorities in his/her home state will not be notified of the offense.
